Trademark Renewal Guide in Oman

Trademark renewal involves obtaining accurate details of the trademark, submitting the filing date and number to the trademark office, completing documents accurately, and submitting official fees. The trademark office then examines the application submitted, ensures that all the fees are accurate and complete, then issues a renewal certificate.

The Renewal process in Oman takes around 2-3 weeks to issue the renewal certificate.

If you forget to renew your trademark before the expiry date, you have a chance to renew it within a grace period. The grace period for renewal in Oman is six months from the expiry date and penalty charges are around USD 800 for the delay in the settlement of renewal fees. If the trademark in Oman is renewed within the grace period, then the owner will have to settle penalty fees.

The registration of a trademark in Oman protects for 10 years from the date of filing, and the protection can be renewed for successive periods of 10 years.

The required documents for renewing a trademark in Oman are:

A power of attorney

A power of attorney is given to whoever you are designating to represent you at the trademark office.

• If you are a local company or a resident of Oman, the power of attorney can be signed and notarized.

• If you are not a resident of Oman, then the power of attorney needs to be legalized at the Oman embassy.

Trade license

• If you are a local company or a resident of Oman, a simple copy of your trade license.

Trademark renewals can be filed 6 months after the expiry date in a period called the grace period. So, if you forget to renew your mark before the expiration date, then you have a six-month grace period to renew the trademark. Renewing a trademark in the grace period yields penalty charges. Failing to renew a trademark in Oman will entitle anyone interested in the mark to cancel it from the register and protect it in their name.

If the owner of the trademark fails to renew the mark within the grace period, the trademark registration will lapse. However, the Law gives the applicant the right to refile the trademark within 3 years after the expiry of the protection period, after which if he doesn’t, then any interested third party can proceed with registering the said mark.
