Trademark Renewal Guide in Pakistan

Trademark renewal involves obtaining accurate details of the trademark, submitting a renewal application, and a proof of use, while not mandatory, providing proof of use of the trademark during the past 5 years can strengthen your case for renewal, and pay the renewal fees. 

The renewal process in Pakistan takes between 2-3 months from the date of filing the renewal, to be completed.

If you forget to renew your trademark before the expiry date, you have a chance to renew it within a grace period. The grace period for renewal in Pakistan is 6 months from the expiry date and penalty charges are around USD290. If the trademark in Pakistan is renewed within the grace period, then the owner will have to settle penalty fees.

In Pakistan, the protection of a trademark starts from the date of filing and lasts for ten years from the filing date. The renewal application can be filed before 6 months of the valid protection period.

The required documents for renewing a trademark in Pakistan are:

Proof of use

• When renewing a trademark for the second time, you may need to provide evidence of its use.

If a trademark is not renewed within the stipulated deadline, the same will be published in the Trademarks Journal under the heading “Unpaid Renewal Fee”. Late renewal, renewal with surcharge, of a trademark application is possible within 4 months from the date of publication of the trademark in the Trademarks journal under the heading “Unpaid Renewal Fee”, upon payment of the renewal fee and the late filing fee. 

In case where renewal and renewal with surcharge period of a trademark application has lapsed the Applicant of the trademark can file a request for restoration of the trademark application within 6 months from the date of removal of the trademark application, along with the renewal and restoration fee, as applicable. However, restoration of the trademark is subject to the satisfaction of the Pakistan IPO. Renewing a trademark in the grace period yields penalty charges.
